Terms & Conditions

1. Agreement to Terms

These Terms and Conditions constitute a legal agreement between you (the "Guest" or "Client") and Nautiq ("we", "us", "our"), operating yacht charter services in Kuantan, Pahang, Malaysia.

By booking a charter with us or using our services, you agree to be bound by these terms. If you do not agree to these terms, you may not book our services.

Guests must be at least 18 years of age to make a booking. Bookings on behalf of minors must be made by a parent or legal guardian who accepts full responsibility.

2. Service Description

Nautiq provides private yacht charter services along the Pahang coast, including but not limited to:

  • Kuantan River Mouth Cruise (approximately 2.5 hours)
  • Pahang Coast Full Day Charter (approximately 8 hours)
  • East Coast Island Retreat (2 days, 1 night)

Services include vessel use, experienced crew, safety equipment, and provisions as specified for each charter type. Specific inclusions are detailed during the booking process.

Charter availability is subject to weather conditions, vessel maintenance schedules, and crew availability. We reserve the right to modify or cancel charters when safety or operational requirements dictate.

3. Booking and Confirmation

To secure a booking, you must:

  1. Submit a charter request via our website, email, or phone
  2. Receive confirmation of availability from Nautiq
  3. Pay the required deposit within 48 hours of confirmation
  4. Provide all necessary guest information including emergency contacts

Your booking is not confirmed until we have received your deposit and sent you a booking confirmation email. Confirmation emails will include charter date, vessel details, departure time, and payment information.

Bookings are subject to availability and are processed on a first-come, first-served basis.

4. Pricing and Payment

Charter rates are quoted in Malaysian Ringgit (MYR) and include:

  • Vessel hire for the specified duration
  • Crew services (skipper, deckhand, cook where applicable)
  • Safety equipment and insurance
  • Provisions as detailed for each charter type

Payment Schedule:

  • Deposit: 30% of total charter cost due within 48 hours of booking confirmation
  • Balance: 70% due 14 days before charter departure date
  • Accepted payment methods: Bank transfer, credit card (processing fees may apply)

Failure to pay the balance by the due date may result in cancellation of your booking with forfeiture of the deposit.

5. Cancellation and Refund Policy

Cancellations by Guest:

  • More than 30 days before departure: Full refund minus 10% administrative fee
  • 15-30 days before departure: 50% refund of total charter cost
  • Less than 15 days before departure: No refund

Cancellations by Nautiq:

We reserve the right to cancel charters due to weather conditions, vessel mechanical issues, or other circumstances beyond our control. In such cases:

  • Full refund of all payments made, or
  • Rescheduling to an alternative date at no additional charge

Nautiq is not liable for any additional expenses incurred by guests due to charter cancellation, including but not limited to travel costs or accommodation bookings.

6. Weather and Route Changes

The safety of our guests and crew is paramount. The skipper has final authority over all operational decisions, including:

  • Departure time adjustments based on weather forecasts
  • Route modifications to avoid unsafe conditions
  • Early return to port if conditions deteriorate
  • Postponement or cancellation of the charter

No refunds are provided for route changes made for safety reasons during a charter. If a charter is shortened due to weather after departure, we will assess refunds on a case-by-case basis.

Marine forecasts are monitored continuously. Guests will be notified as soon as possible of any significant changes to scheduled departures.

7. Guest Responsibilities

Guests agree to:

  • Arrive at the designated departure point at the specified time
  • Follow all safety instructions provided by the crew
  • Wear provided life jackets when directed by crew
  • Not consume alcohol excessively or use illegal substances
  • Respect the vessel, equipment, and marine environment
  • Inform us in advance of any medical conditions, dietary requirements, or mobility limitations
  • Provide accurate emergency contact information
  • Supervise any minors in their group at all times

Guests who endanger themselves, other guests, crew, or the vessel may be refused boarding or disembarked at the nearest safe location without refund.

Guests are responsible for bringing appropriate clothing, sun protection, and any personal items needed for the charter.

8. Health and Medical Considerations

Guests should be aware that yacht charters involve physical activity and exposure to marine conditions. You should not participate if you:

  • Have severe mobility limitations that would make boarding or moving around the vessel unsafe
  • Are pregnant (particularly for offshore passages)
  • Have serious cardiac or respiratory conditions
  • Are prone to severe seasickness

If you have any medical conditions that could affect your ability to participate safely, you must disclose these during booking. We reserve the right to refuse participation based on health and safety concerns.

Crew members are trained in basic first aid, but we are not medical professionals. Guests are responsible for bringing any necessary medications.

9. Liability and Insurance

Nautiq maintains comprehensive marine insurance covering vessel operations and third-party liability. Guests are covered under this policy for incidents occurring during the charter within the scope of normal charter activities.

Limitation of Liability:

To the fullest extent permitted by Malaysian law, Nautiq shall not be liable for:

  • Loss or damage to personal belongings
  • Indirect or consequential losses
  • Delays or cancellations due to weather, mechanical issues, or force majeure events
  • Injuries resulting from guest failure to follow safety instructions
  • Seasickness or discomfort from marine conditions

Our total liability for any claim shall not exceed the total amount paid for the charter.

Guests are strongly advised to obtain their own travel insurance covering personal injury, medical expenses, and trip cancellation.

10. Intellectual Property

All content on our website, including text, images, logos, and design elements, is owned by Nautiq and protected by Malaysian and international copyright laws.

Guests may take photographs during their charter for personal use. We occasionally take photographs during charters for marketing purposes. If you do not wish to be photographed, please inform the crew at the beginning of your charter.

By participating in a charter, you grant Nautiq permission to use photographs that may include you in promotional materials unless you specifically opt out.

11. Privacy

Your personal information is collected and used in accordance with our Privacy Policy. Please review our Privacy Policy for details on how we handle your data.

12. Force Majeure

Nautiq shall not be liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Severe weather conditions or natural disasters
  • Government restrictions or maritime authority directives
  • Acts of war, terrorism, or civil unrest
  • Pandemics or public health emergencies
  • Vessel damage or mechanical failure despite proper maintenance

In force majeure situations, we will work with guests to reschedule charters or provide refunds as appropriate.

13. Dispute Resolution

These terms are governed by the laws of Malaysia. Any disputes arising from these terms or charter services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Before initiating legal proceedings, parties agree to attempt to resolve disputes through good faith negotiation. If a dispute cannot be resolved within 30 days, either party may pursue legal remedies.

14. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated effective date.

Bookings made before changes take effect will be governed by the terms in place at the time of booking. Continued use of our services after changes constitutes acceptance of the modified terms.

Significant changes will be communicated to guests with existing bookings via email.

15. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
